These Terms of Use (“Terms”) govern your use of Ballet AI, operated by Andrea Payette (“Ballet AI,” “we,” “us,” or “our”). By creating an account or using Ballet AI, you agree to these Terms and the Privacy Policy.
1. Ballet AI
Ballet AI is a software tool designed to provide movement-specific ballet technique feedback, practice guidance, progress features, and AI-assisted coaching based on supported inputs. Ballet AI is not a substitute for an in-person ballet teacher, medical professional, physical therapist, or other qualified professional.
2. Eligibility
You must be at least 13 years old to use Ballet AI. If you are under the age of majority where you live, you may use Ballet AI only as permitted by applicable law and with any parent or guardian involvement that law requires. If a parent or guardian accepts these Terms on behalf of a minor, that adult agrees to be responsible for the minor's use of the service. Ballet AI does not operate a parental-consent or independent age-verification process and relies on the age bracket provided by the user. We may suspend or close an account if we learn the user is under 13.
3. Your account
You are responsible for maintaining access to your sign-in credentials and for activity conducted through your account. You agree to provide information that is accurate to the best of your knowledge and not to misuse another person's account.
4. Your content
You retain ownership of practice videos and other content you submit. You grant Ballet AI a limited, non-exclusive license to host, process, reproduce, transmit, and otherwise use that content only as reasonably necessary to operate, secure, improve, and provide the service and its requested features, subject to our Privacy Policy.
5. AI-generated feedback
Ballet AI uses automated systems and AI models. Feedback can be incomplete, uncertain, or incorrect. Ballet AI may intentionally leave an element unassessed when the system cannot evaluate it reliably. You are responsible for deciding how to use any feedback and should stop an exercise if you experience pain or believe an activity may be unsafe.
6. Acceptable use
You may not use Ballet AI to violate law; infringe another person's rights; upload content you do not have the right to use; interfere with or reverse engineer the service except where applicable law permits; bypass security or subscription controls; probe or overload the service; or use the service to harm, harass, exploit, or impersonate others.
7. Supported features
Available movements, analysis capabilities, Coach features, and other functionality may change over time. We do not promise that every movement, camera angle, video, or technique element can be analyzed.
8. Subscriptions
Ballet AI may offer auto-renewing monthly and annual subscriptions through Apple's App Store. The price shown in the App Store at the time of purchase controls. Payment is charged through your Apple account. Subscriptions renew automatically unless canceled through Apple in accordance with Apple's subscription rules. Apple processes billing, cancellations, and eligible refunds; Ballet AI does not receive your payment-card details.
9. Introductory offers
An introductory offer may be available for an eligible subscription only when Apple indicates that the account is eligible. Eligibility, duration, conversion, and billing are controlled through the App Store purchase flow. An offer shown to one user is not a promise that the same offer is available to every user.
10. Account deletion and subscriptions
You may delete your Ballet AI account using the in-app deletion feature. Account deletion removes service data as described in the Privacy Policy, but it does not automatically cancel an App Store subscription. Manage or cancel your subscription through Apple.
11. Intellectual property
Ballet AI, its software, branding, designs, text, and other service materials—excluding content you own—are owned by or licensed to Ballet AI and are protected by applicable intellectual-property laws. “Ballet AI™” is used as a trademark.
12. Availability and changes
We may modify, suspend, or discontinue features and may perform maintenance or make changes necessary for security, legal compliance, reliability, or product development. We do not guarantee uninterrupted availability.
13. Disclaimers
To the maximum extent permitted by law, Ballet AI is provided “as is” and “as available,” without warranties of any kind, express or implied. We do not warrant that automated analysis or coaching will be error-free, complete, or appropriate for every dancer or circumstance.
14. Limitation of liability
To the maximum extent permitted by applicable law, Ballet AI and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or other intangible losses arising from use of or inability to use the service. Nothing in these Terms excludes liability that cannot lawfully be excluded.
15. Indemnity
To the extent permitted by law, you agree to be responsible for claims, losses, and reasonable costs arising from your unlawful misuse of Ballet AI, your violation of these Terms, or content you submit in violation of another person's rights.
16. Apple terms
If you use Ballet AI on an Apple device, these Terms are between you and Ballet AI, not Apple. Apple is not responsible for the app or its content and has no obligation to provide maintenance or support services for Ballet AI. Your use is also subject to applicable Apple terms, including Apple's Standard Licensed Application End User License Agreement where applicable. To the extent required by Apple's terms, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce applicable provisions against you.
17. Governing law
These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict-of-laws principles, except to the extent the law where you live requires otherwise.
18. Changes and contact
